The Madrid Protocol for international registration of trademarks entered into force in Colombia from 29th August 2012. From that date on, Colombia can be designated in any new international registration and existent international registrations can be extended to that country.
The Colombian National Trademark Office will issue soon the internal regulation applicable to international registrations designating Colombia. The rules will basically contain the following provisions:
– a national application number will be assigned to any international registration designating Colombia
– the National Trademark Office will perform a formal and a substantial examination of the international application and will issue any provisional refusal of protection
– the international application will be published in the Industrial Property Colombian Gazzette for opposition purposes; any opposition should be filed within 30 days from the publication date
– the validity of the national registration resulting from the International Registration designating Colombia, will be counted from the International Registration date.
